Zero Car Rental Website, Mobile App and Rental Terms and Conditions

Introduction

These Terms and Conditions govern your access to and use of the Zero Car Rental website, any associated mobile applications, and all vehicle rental services provided by Zero Car Rental Limited. The Platform is operated by Zero Car Rental Limited, a company incorporated in New Zealand.

By accessing, browsing, or using the Platform, or by making a booking, you agree to be bound by these Terms and all applicable New Zealand laws and regulations. If you do not agree to these Terms, please do not use the Platform or services.

Zero Car Rental reserves the right to update or amend these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.

Use of the Platform

The Platform is provided for personal and non commercial use only. You agree that you will not engage in the following activities.

  • Use the Platform for any unlawful purpose

  • Copy, reproduce, distribute, or commercially exploit Platform content

  • Interfere with Platform security, servers, or networks

  • Attempt unauthorised access to systems or data

  • Infringe Zero Car Rental intellectual property rights

  • Frame, mirror, scrape, or deep link the Platform without written consent

Zero Car Rental may suspend or terminate access to the Platform at its discretion and without notice.

Platform Modifications

Zero Car Rental may modify, suspend, or discontinue any part of the Platform or its services at any time without notice or liability.

Privacy Policy

Use of the Platform is subject to our Privacy Policy, which governs how personal information is collected, stored, and used in accordance with New Zealand privacy law. By using the Platform, you consent to such processing.

Links to Third Party Websites

The Platform may contain links to third party websites or services. Zero Car Rental is not responsible for the content, availability, or privacy practices of third party sites and does not endorse them.

Reservations and Bookings

All bookings are subject to availability and acceptance. Prices displayed include GST, comprehensive insurance, and unlimited mileage unless stated otherwise. A minimum rental period may apply. Online bookings are requests only and the rental agreement is finalised at vehicle pickup. Zero Car Rental reserves the right to refuse or cancel a booking where necessary.

All vehicle reservations must be made a minimum of 24 hours prior to the intended pick up time. Same day bookings are not permitted.

Rental Requirements

To rent and drive a Zero Car Rental vehicle, the primary driver and all authorized additional drivers must hold either a valid New Zealand Full Driver License or a valid International Full Driver License. Learner, restricted, or provisional licenses will not be accepted under any circumstances.

Overseas licences must be in English or accompanied by an official translation. All drivers must be legally entitled to drive in New Zealand. Only approved drivers listed on the rental agreement may operate the vehicle.

Vehicle Collection and Return

Vehicles may be collected and returned only at the agreed time and location, including but not limited to the following.

  • Auckland International Airport public carpark

  • Auckland Domestic Airport public carpark

  • Auckland CBD within a 20km radius where delivery is available

  • SkyCity Hotel in Auckland CBD

Late returns may result in additional charges.

Vehicle Condition and Inspection

Customers are encouraged to inspect the vehicle at pickup. Photos or videos may be taken before signing the rental agreement. Any existing damage must be recorded before departure. Vehicles must be returned in reasonable condition, allowing for normal wear and tear.

The renter is responsible for the safekeeping of the vehicle keys at all times. If the vehicle key is lost, damaged, or stolen during the rental period, a flat replacement fee of $500 NZD will be automatically deducted from your authorized credit card hold.

Insurance Excess and Liability

In the event of an accident, damage, or theft, the renter is liable to pay a standard insurance excess deductible ranging between $800 and $1500 NZD per incident, depending on the severity of the damage. However, this excess charge will be waived or fully refunded if Zero Car Rental determines you are not at fault AND you have provided the complete contact, vehicle, and insurance details of the at-fault third party. If you fail to provide these third-party details, or if you are deemed at fault, the excess fee will be charged.

Due to our insurance policy requirements, additional excess charges apply on top of the standard excess for younger drivers or those with less experience. If an accident occurs while the vehicle is being driven by a person fitting the following categories, the total excess liability will be increased by the following amounts.

  • Drivers under 21 years of age incur an additional $1000 NZD excess.

  • Drivers aged 21 to 24 years of age incur an additional $500 NZD excess.

  • Drivers aged 25 or over who have held a full New Zealand driver license for less than 12 months incur an additional $500 NZD excess.

The renter will be held 100 percent financially responsible for all damage, recovery costs, and third party liabilities, voiding all insurance cover, if the vehicle is involved in an incident under any of the following circumstances.

  • The driver is under the influence of alcohol or drugs, exceeds the legal blood or breath alcohol limit, or fails to supply a blood or breath test as required by law.

  • The driver fails to stop or remain at the scene of an accident as required by law.

  • The vehicle is being driven by an unauthorized driver, a person without the appropriate class of license, or a person breaching their license conditions.

  • The damage arises from any intentional, reckless, or illegal act, or if the vehicle is used for racing, pacemaking, reliability trials, hill climbing, or speed tests.

  • The vehicle is driven in a known unsafe condition or is loaded or operated in excess of the manufacturer recommended specifications.

  • The damage is caused by the introduction of contaminated fuel or the incorrect type of fuel into the vehicle.

  • The vehicle is driven outside the permitted description of use or off standard and maintained roadways without prior written consent.

Payments and Cancellations

Secure online payment gateways are used. Cancellations made at least 24 hours before the scheduled vehicle pick-up time are free of charge. Cancellations made within 24 hours of the scheduled pick-up time will incur a late cancellation fee equal to 15% of the total rental cost. No-shows or failure to collect the vehicle may also result in this charge. Any applicable excess or damage costs may be charged following vehicle return.

Fuel Policy

Vehicles are supplied with a full tank of fuel and must be returned with a full tank. If the vehicle is returned without a full tank, a flat refuelling fee of $100 NZD will be automatically deducted from your security deposit or authorized credit card hold.

Traffic Offences and Fines

The renter is fully responsible for all traffic infringements, parking fines, toll charges, and speeding violations. In the event of an infringement, Zero Car Rental reserves the right to either transfer the liability of the fine directly to the renter name and license, or deduct the full cost of the fine plus any applicable administration fees directly from the renter account or security hold.

Breakdowns and Accidents

In the event of a breakdown or accident, the renter must complete the following steps.

  • Contact Zero Car Rental immediately

  • Collect the full name, contact number, address, driver license details, vehicle registration number, and insurance company name of any other parties involved in the accident.
  • Take photos of the accident scene and all vehicles involved, if it is safe to do so.
  • Not arrange repairs without authorisation

  • Complete any required accident or incident reports

Electronic Communications

By using the Platform, you consent to receive communications electronically, including confirmations, reminders, notices, and rental agreements.

Intellectual Property

All Platform content, including text, graphics, logos, images, layout, and software, is the property of Zero Car Rental or its licensors and is protected by intellectual property laws. Content may be viewed or printed for personal use only. Any other use requires prior written consent.

User Submitted Information

Any feedback, comments, suggestions, or materials submitted to Zero Car Rental may be used without compensation for business, service improvement, or marketing purposes.

No Warranty

The Platform and its content are provided as is and as available. Zero Car Rental makes no guarantees that the Platform will be uninterrupted, error free, or fully secure. Use is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Zero Car Rental shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform or services. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that cannot be excluded under New Zealand law including the Consumer Guarantees Act 1993.

Indemnity

You agree to indemnify and hold harmless Zero Car Rental, its directors, employees, and agents from claims, losses, or damages arising from misuse of the Platform or breach of these Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the non exclusive jurisdiction of New Zealand courts.

General

If any provision is deemed unenforceable, the remaining provisions remain valid. Headings are for reference only. These Terms constitute the entire agreement between you and Zero Car Rental regarding use of the Platform and rental services.

New Zealand Road Rules and Driver Responsibilities

All drivers must comply with New Zealand road laws, including speed limits, road signage, mobile phone restrictions, and drink driving laws. Drivers unfamiliar with New Zealand driving conditions are responsible for ensuring they understand local road rules, including driving on the left hand side of the road. Zero Car Rental is not responsible for penalties, infringements, or losses arising from failure to comply with New Zealand road rules.

Toll Roads New Zealand

Some New Zealand roads are toll roads, including but not limited to the Northern Gateway Toll Road and Tauranga Eastern Link. Vehicles may pass through toll roads without stopping. The renter is responsible for all toll charges incurred. Unpaid tolls may result in administration or enforcement fees. Zero Car Rental may recover toll charges and associated costs from the renter.

Airport and Public Carpark Disclaimer

Where vehicle collection or return occurs at Auckland International Airport, Auckland Domestic Airport, or public and third party carparks, Zero Car Rental is not responsible for parking fees charged by carpark operators, availability of specific parking bays, or actions and policies of third party carpark providers. Any applicable parking fees are the renter responsibility unless expressly stated otherwise.

Traffic Infringements and NZ Enforcement Agencies

Traffic infringements issued by New Zealand authorities, including NZ Police, Waka Kotahi NZ Transport Agency, and local councils, may be processed after the rental period ends. Where permitted by law, infringement notices may be transferred to the renter and an administration fee may apply for processing enforcement notices.

Consumer Guarantees Act and Fair Trading Act

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. Where services are acquired for business purposes, the Consumer Guarantees Act may not apply to the extent permitted by law.

Natural Events and Force Majeure

Zero Car Rental is not liable for delays, cancellations, or inability to provide services due to events beyond reasonable control, including but not limited to severe weather events, earthquakes or volcanic activity, road closures or government restrictions, and fuel shortages or emergency declarations.

GPS Maps and Navigation Disclaimer

Any GPS, navigation system, or map provided with the vehicle or accessed via the Platform is supplied for convenience only. Zero Car Rental does not guarantee accuracy, real time updates, or suitability for specific routes, including rural or remote areas. Drivers must exercise independent judgement when navigating.

Biosecurity and Restricted Areas

Drivers must comply with New Zealand biosecurity laws and restrictions. Vehicles must not be taken into restricted zones or used in a manner that breaches biosecurity regulations. Any penalties, cleaning costs, or losses arising from non compliance are the renter responsibility.

Overseas Drivers and International Visitors

Overseas drivers acknowledge that driving conditions in New Zealand may differ significantly from their home country. Narrow roads, rural highways, and variable weather conditions are common, and extra caution is required at all times. Zero Car Rental strongly recommends overseas visitors familiarise themselves with official New Zealand driving guidance before operating a vehicle.

These Terms are intended to comply with New Zealand law and are to be interpreted accordingly.
